ARCHITECTURAL REVIEW

Your Association's Declaration of Protective Covenants requires that before any modifications can be made to the exterior of any residence or to any lot, approval by the Architectural Review Committee is required.

The Sunburst Hills Property Owners Association, Inc. (SHPOA, Inc.) Architectural Review Committee is composed of the Board of Trustees or a committee appointed by the Board. The purpose of the review process is to assure that ‘The Greens’ at Sunburst Hills remains a first class residential community. To further this purpose, The Board of Trustees has adopted architectural and landscape rules and regulations.

Any resident who wishes to make an exterior modification(s) to their residence or lot (examples include but are not limited to exterior additions, roofs, repainting, play sets, basketball hoops, swimming pools, decks, fences, etc., should submit his/her request, in writing, including specifications, diagrams or drawings if required, to the President or Vice President of the Board, at least 30 days prior to the anticipated start of work. The submission can be accomplished as follows:

Township construction permits may also be required.

Failure to adhere to the architectural review process may result in penalties from both the Township of East Brunswick and the Sunburst Hills Property Owners Association, Inc.

ANTENNA/SATELLITE DISHES

Satellite Dishes 18" or less (examples: DishNetwork, DirectTV, etc.,) are permitted. Dishes may be installed on the rear roof of a home. No satellite dishes shall be allowed on the roof of a garage or side wall of the home. External television antennas are not permitted. No roof top antennas or radio transmission antenna shall be erected on lots or in the common grounds community areas. Failure to adhere to the antenna/satellite dish regulation may result in penalties from the Sunburst Hills Property Owners Association, Inc.

MAINTENANCE AND REPAIRS

Owner shall be responsible for maintenance, repair and decoration on Owners, Lot, structural or otherwise, including but not limited to exterior and all walls, foundation, roofs, fences, front service walks and painting. The owner shall effectuate all such repairs and maintenance when necessary. If the owner shall fail to effectuate such repairs and maintenance within a reasonable time after notice from the association, the association shall have the right to effectuate such repairs and maintenance and add the cost of the same, together with a reasonable service charge, to the next payment of the Owner's annual assessment. Such cost and service charge shall become a lien on the property in accordance with the terms of this declaration.  

LANDSCAPING MAINTENANCE

Owner shall be responsible for landscaping (periodic cutting of lawn, shrubs, trees, etc.) and removal of weekly sales papers and other printed information on Owners Lot. Ordinances of the Township of East Brunswick apply. Failure to adhere to landscaping maintenance rules and regulations may result in penalties from both the Township of East Brunswick and the Sunburst Hills Property Owners Association, Inc.


VEHICLES

No vehicle that is owned by a homeowner member of the Association or a rental tenant without current State inspection sticker and vehicle registration plates and is therefore in a non-operative condition (i.e., can not be legally operated on the roads of the State of NJ and the streets of the Township of East Brunswick) shall be parked in the community common elements parking lots. A vehicle that is parked for twenty-four (24) hours without current inspection sticker and registration plates is deemed as non-operative and will be reported to the East Brunswick Township for further identification actions. Once identification actions have been taken, the owner will receive a penalty of a fine plus the cost of parking storage.

a. If the owner is a homeowner/resident of the community, the owner will be given up to forty eight (48) hours to remove the vehicle or make it operations with the appropriate inspections and license plates; otherwise the Association will have the vehicle towed at owner towing and storage expenses.

i. The cost of towing and storage will be the responsibility of the vehicle owner and neither the Association nor the Board will be liable for any damages associated with the removal and storage of said vehicle.

b. If the owner is a non-Association member/homeowner, i.e., a visitor the owner will be requested to remove the vehicle immediately, i.e., twelve (12) hours or less otherwise the Association will have the vehicle towed at owner towing and storage expenses.

i. The cost of towing and storage will be the responsibility of the vehicle owner and neither the Association nor the Board will be liable for any damages associated with the removal and storage of said vehicle.

ii. The non-Association member/homeowner will be billed by the Association’s Attorney for the fine, storage and any legal fees associated with communicating to this individual(s). Failure to pay will result in the Association seeking payment through the Middlesex County small claims court processes.

No vehicle that is owned by a homeowner member of the Association or a rental tenant with current State inspection sticker and vehicle registration plates but is in a mechanical non-operative condition i.e., (will not start, has been in a auto accident and cannot be driven, has been vandalized and cannot be driven) shall be parked in the community common elements parking lots for more than seven (7) consecutive days. Vehicles which are deemed to be non-operative or in storage will have a warning notice placed on their windshield advising the owner to remove the vehicles from the parking slot within twenty-four (24) hours. Failure to comply will result in the owner receiving a penalty of a fine and the vehicle will be towed. The cost of towing and storage will be the responsibility of the vehicle owner and neither the Association nor the Board will be liable for any damages associated with the removal and storage of said vehicle.

No vehicle that is owned by a homeowner member of the Association or a rental tenant with current State inspection sticker and vehicle registration plates can be parked in the same slot for thirty (30) consecutive days or more without being periodically moved.

c. A vehicle is deemed as non-operative or in storage when it has been parked in the same slot for thirty (30) consecutive days or more without being started and temporarily moved, i.e., moved for up to three (3) hours. The owner will receive a warning notice from the Association requesting that the vehicle be started and moved such that all homeowners can compete for the parking slot. Failure to comply and repeat warnings will most likely result in a penalty with a fine.

Trailers, trucks, campers, buses, house vans, construction equipment, commercial vehicles (includes: dealer, livery, and taxi license plates) and equipment, jet skis, snowmobiles, and vans shall not be parked in the community common elements parking lots(i.e. Buttonwood East, Buttonwood West, Allison Drive slots ( 7 and 2) at any time. No vehicle can be parked on common area landscaped grounds (i.e. unpaved parking lots). Failure to comply with this rule will result in the offending item being towed and the resident receiving a fine.

The cost of towing and storage will be the responsibility of the items owner and neither the Association nor the Board will be liable for any damages associated with the removal and storage of said item. The exceptions to this rule/regulation are as follows:

 

  • Small trucks and vans belonging to residents having a capacity of not more than ¾ ton may be parked in the interior parking slots of Buttonwood East and West common elements parking lots.
  • Construction equipment or commercial vehicles that belong to contractor’s or repair individuals who are working to improve, maintain, or restore services for a homeowner’s property or common property owned by the Association is granted reasonable time on a daily basis to complete their appropriate work.
  • Moving vans are allowed adequate time to be loaded or unloaded; maximum of 12 hours

Commercial automobile repair shall not be allowed in community common element parking lots. Except that residents may perform or have performed items having an elapsed repair time of less than or equal to Six (6) hours. Homeowners will be held accountable for cleaning up any spills of automobile fluids caused by such repairs. In order to avoid damage to vehicles and homes no games of football, basketball, hockey, baseball/softball or soceer are allowed in the community common elements parking lots. Except homeowners may on occasion engage in the tossing of nerf balls for any of the aforementioned games to pre-school children during periods when the parking lots are reasonably empty.

 

PAINTING/EXTERIOR COLOR


No owner may change the exterior color of his unit (includes: windows, doors, gutters, soffit, garage doors, trim, roofing, shutters) from its original color unless approved by the Architectural Committee and be within the range of colors approved by the Planning Board of the Township of East Brunswick.

ENFORCEMENT OF RULES

The Board of Trustees or the Architectural Review Committee has the right to enforce the performance of the covenants, by-laws, restrictions, rules and regulations, and may use lawful remedies to do so. Failure to enforce any covenant, by-law, rule and regulation or restriction does not waive the Association's right to do so thereafter.

BUSINESS USES

Any business use within Sunburst Hills must be approved by the Board of Trustees and receive any required State or Township approvals.

NUISANCES

No obnoxious, unsightly or offensive activities, including vehicle repairs, which are or may become an annoyance or nuisance, will be permitted on any lot, common area or street. Except that:

  • Residents may perform or have performed the following items having an elapsed repair time of less than or equal to three (3) hours: vehicle glass replacement, installation of vehicle battery, license plates, fuses, headlamps / tail lamps, changing of vehicle flat tire, replacement of windshield wipers, car detailing.
  • · Holiday decorations that are not noxious or offensive may be carried upon a homeowner’s lot. Homeowner’s should remove the decoration in a period not to exceed three (3) weeks from the last day of the holiday period.


OUTDOOR AND PLAYGROUND EQUIPMENT

Permanent and semi-permanent outdoor equipment such as playgrounds, basketball backboards, trampolines, etc. are required to be approved by the Association. Compliance with township ordinances is required. No games of football, basketball, hockey, baseball / softball or soccer are allowed in the community common elements parking lots. Except homeowners may on occasion engage in the tossing of nerf balls for any of the aforementioned games to pre-school children during periods when the parking lots are reasonably empty.



PETS

Cats, dogs and other domestic or household pets are permitted provided, however, that such pet may not be kept for any commercial purpose. All pets are subject to the Township of East Brunswick ordinances. Pets shall not be permitted in the common grounds community areas or other homeowners’ property unless accompanied by the owner and unless they are leashed. Owners shall also clean up after their pets have “soiled” common grounds community areas and other homeowners’ property. Failure to clean-up will result in a warning. Repeat offenders will most likely receive a penalty with a fine.



RECREATION VEHICLES AND PERSONAL PROPERTY

No outdoor storage of recreational vehicles or seasonal play equipment will be permitted, including snowmobiles, boats, RV's, trailers, campers, golf carts, wading pools, etc.  

 

No vehicle may be parked for repairs on driveways parking lots or public roadways. REFUSE/TRASH AND RECYCLABLES

The township of East Brunswick provides residents with recycling and solid waste collections. Residents will place refuse containers and recyclables at the curb before 7 AM on collection day, but no more than12 hours prior to the collection day. Items must be properly bundled, bagged, tied or placed in garbage receptacles. Empty containers MUST be removed from the curb by evening of collection day, i.e.; before 12 midnight. All solid waste / trash MUST be placed in NUMBERED trash containers with lids or in large black garbage bags with ties.White garbage bags are not permitted. Recycling material should be in East Brunswick supplied 20 gallon NUMBERED yellow recycling barrels. Newspapers must be bundled and tied with a string or placed in East Brunswick supplied NUMBERED blue container with lid. Cardboard must be bundled and tied. Junk mail, high grade and mixed paper bundled and tied or secured in a brown paper bag. Failure to adhere to REFUSE / TRASH AND RECYCLABLES rules and regulations may result in penalties from both the Township of East Brunswick and the Sunburst Hills Property Owners Association, Inc.

ROOFS

The Board must approve any roof modifications. All requests must be submitted in writing and mailed to the Association either by USPS, (P.O. Box 842) or emailed to thegreens@shpoa.com

SIGNS

No real estate "For Sale" signs larger than a standard and customary size will be permitted on any lot. No other signs (including garage sale, identification, advertising, political or directional signs) will be permitted without the prior approval of the Board. The exception to this rule / regulation is as follows: As of December 2007, permanent security signage is permitted. Homeowners must obtain the Board’s approval using the following process:

Provide the following information:

  • Name of your home security system provider
  • Your acceptance of the following security sign or security sticker rules
    • A homeowner can have either a security sign or security sticker
      • A maximum of one (1) security sign displayed externally on the property
      • Sign must not exceed 10 inches by 10 inches in size and cannot be illuminated
      • Sign must be located no more than three (3) feet from the front wall of the dwelling
    • A homeowner can have a maximum of two (2) security stickers displayed in their home.
      • Stickers must not exceed 5 inches by 5 inches in size and cannot be illuminated
      • One sticker can be positioned in a first floor front window and a second sticker can be positioned on a first floor exit door

 

The Board will respond to your signage approval email with an approval or denial within three (3) business days of receipt.

 

Board Reminder Note:

The Board does not promote, recommend or approve your home-security system or provider. Our approval is 100 percent of the provider’s signage; that it is compliant with specifications.



OUTDOOR STRUCTURES

No dog run, doghouse, dog kennel, or swimming pool may be constructed.

No fences, walls, storage sheds or accessory structures may be maintained, constructed or erected on any Lot without the consent of the Association and the Township of East Brunswick.

Outdoor Clothes Lines or Racks are not permitted.


STORAGE TANKS

No tank for the storage of gas or liquids may be maintained on any Lot unless hidden from external view of any other Lot. Appropriate state and municipal laws apply.
